Rob,
Thank you for responding to Le's email. I believe it to be important to
both of us that we keep this dialog open so that we can reach a mutually
amicable resolution.
I am a little surprised however at the lack of response to the most
major points in the email I sent on May 10, 2007. I thought that I had
made our intentions, as well as our proposal clear, but I will restate
them in an attempt to clarify any misconceptions.
Our goal is now, and always has been to attain a resolution to the most
significant issues that surround the construction of our home. While I
still believe the rocks in the back yard to be one of these, we are
willing to drop that issue as a compromise, if you are willing to
resolve the other two.
Our proposal is that if you will reimburse us for the drainage repair
($450) and for the driveway we should not have had to replace ($5,500)
then we will both drop the issue of the rocks, and have the websites you
mentioned taken down.
To be very clear, we are rejecting your proposal of having the websites
pulled down in return for you paying $450.
At this point, we would like to hear your thoughts on our proposed
solution so that we can determine a path forward.

Thank you for your prompt response to our inquiry. We are very pleased
that you are willing to resolve the drainage situation, and completely
understand that you cannot be expected to guarantee any work you do
not perform, and would never ask you to do so.
Our goal has been, and continues to be to attain a resolution to some
of the major issues we've encountered with the house. The most major
of these was the driveway that we had to replace due to the fact that
we simply could not get cars in and out of it without causing damage
to the vehicles, and the driveway itself. It was something that we
attempted to resolve as soon as it was discovered, but were met with
only resistance when you stated that it was "sufficient" despite
measurements, photos, and documentation to the contrary.
I still believe that the retaining wall is another of these major
issues, but am willing work towards a resolution through compromise.
<My_Wife>and I would be willing to drop the issue of the retaining wall, and
arrange to have the websites mentioned below pulled down if CW will
reimburse us for the drainage work ($450) and the expenses incurred
from replacing the driveway ($5,500).
Such a resolution would result in a more amicable situation both for
CW and for us and would allow all parties to move past this
unpleasantness. I hope that you will consider this proposal seriously,
and I look forward to your response.
